According to the G1 website, until this Monday, the ministers Flavio Dino, Alexandre de Moraes and Carmen Lucia Antunes voted against the appeal of the defense of the former governor for the penalty of 40 000 reais (about seven thousand dollars) for irregular elective diffusion against Lula’s formula during the 2022 campaign.
The head of the First Chamber, Justice Cristiano Zanin, declared himself barred from participating in the analysis of the case.
The only pending vote was that of Justice Luiz Fux, who would vote next Friday.
According to the Superior Electoral Court (TSE), Bolsonaro’s team promoted content that violated the voting legislation in force.
The defense lawyer of the far-right politician appealed to the STF with the argument that the measure represented an affront to the constitutional rights of freedom of expression and information.
However, the rapporteur of the case in the Supreme Court, Judge Dino, had rejected this argument in a monocratic decision.
The defense insisted and the issue was taken to the virtual plenary of the first chamber.
In justifying his position, Dino argued that ‘there is no violation in the decision of the TSE, which is duly grounded and in line with the legislation’.
The trial should continue until April 4, unless any minister requests a hearing or asks for a face-to-face analysis of the case.
