Ecuador awaits ruling on constitutionality of presidential decree

Quito, Jan 24 (Prensa Latina) Ecuador is still awaiting a ruling from the Constitutional Court on the controversial Executive Decree 500, by which President Daniel Noboa requested leave to campaign and left Cynthia Gellibert in office.

People’s attention is on the Court because it must issue a ruling on the temporary absence “due to force majeure” that the president took to campaign for reelection and entrusted power to Gellibert instead of Verónica Abad, the incumbent vice president.

This Thursday Noboa decided to delegate the leadership of the Government to Gellibert for the third time, whom he ratified as acting vice president. The president issued Executive Decree 513, which handed over power to Gellibert from 06:00 (local time) on January 24th until 06:00 (local time) on January 27th.

The president took advantage of the permission to participate in campaign activities leading up to the elections on February 9 and invoked, as on two previous occasions, a cause of “Major force” to engage in proselytizing activities.

Noboa is one of the 16 candidates who seek the presidency for the period 2025-2029 and, according to article 93 of the Code of Democracy, those officials who seek reelection must request leave to campaign.

Abad, replaced by executive decree, appeared before Parliament on Thursday and asked legislators to investigate and sanction nine members of Noboa’s administration, including several ministers and the person now in charge of their functions.

She urged the assembly members to end the current situation and called on the National Electoral Council, the Electoral Dispute Tribunal, and the Constitutional Court to handle the demands presented to these bodies with transparency, fairness, and a commitment to peace.
