In a statement released this Monday and as part of the process presented to that body by parents’ associations, communities, Non-Governmental Organizations and other interested parties, the TSJ indicated that the fine must be paid to the National Telecommunications Commission of Venezuela.
It indicated that the payment will be made within eight days following the publication of the sentence on the Supreme Court’s website.
The sentence stated that the entity violated the legal system in the Bolivarian Republic and “deliberately disrespected the guidelines, internal regulations and operation implemented by the digital platform itself.”
The Court specified that in the event of non-compliance, the Constitutional Court will take the appropriate measures for the specific case.
Tik Tok was also ordered to establish a representation with its headquarters in the national territory, through which the application of technological tools will be supervised and controlled in accordance with compliance with the constitutional and legal order of Venezuela.
It also demanded the expansion of the multidisciplinary team and the formation of a technical table with the participation of the affected families to quantify the damages for the facts proven in the present case, which included tragic fatal consequences for three adolescents and damages to others.
The Court indicated that the money received from the fine will be used to create a fund called “Tik Tok Victims”, to compensate for the psychological, emotional and physical damage to users, especially if they are children and adolescents.
It explained that as part of the procedures they received representatives of educational centers, affected families, communities organized in defense of the human rights of children, adolescents, the Venezuelan family and representatives of the Churches.
In addition to authorities from the National Telecommunications Commission and the National Telephone Company of Venezuela.
He added that they also received and valued the results of the work and contribution of the multidisciplinary team of experts convened by the Constitutional Court, including experts in psychology, psychopedagogues, various health sciences and cybersecurity, among others.
The ruling noted that they also welcomed a report with the causes and consequences of the so-called viral challenges spread on Tik Tok and facts related to this case, among other multiple and important revelations that revealed the proven aspects.
