After the coup d’état, Conille described as illegal and unconstitutional the plan hatched against him by the Presidential Transitional Council (CPT).
“First of all, I would like to emphasize that this decision directly contravenes both the Constitution and the texts that govern the transition period,” Conille stressed in an open letter.
Article 158 of the Constitution establishes that the prime minister is responsible to Parliament, and that only a resignation or a motion of censure by that legislative body can lead to the termination of his functions, he recalled.
In no case can the Transitional Presidential Council (CPT), even within the framework of its functions, replace Parliament or exercise any power that has not been attributed to it, Conille pointed out.
Although the CPT has the prerogative to appoint the prime minister, there is no legal text that grants it the power to dismiss him, he explained.
Since his dismissal, criminal gangs have kept the Haitian National Police and its foreign reinforcements in check.
This week, gang members blocked traffic on several roads, attacked urban areas, burned houses and even killed a police officer assigned to the SWAT forces.
They also threatened to end the CPT if they did not sit down with them at the negotiating table.
The spiral of violence by armed gangs caused all national and international flights to be suspended at the Toussaint Louverture International Airport.
A Spirit Airlines plane was hit by seven bullets when it was preparing to land, but the pilots reacted and did so in the Dominican Republic. A flight attendant was injured.
