The SCJ found the reformed military officers Jorge Pajarito Silveira and Ernesto Ramas responsible for six crimes of deprivation of liberty, four crimes of abuse of authority against detainees, four crimes of serious injuries and one crime of forced disappearance.
“The forced disappearance has been configured, even if Tassino’s remains are not found, and furthermore the permanence of the crime is indisputable, precisely because, since these did not appear, the crime is perpetuated to the present,” the sentence cites.
This is the first time that the SCJ admits the typification of the crime of forced disappearance. According to La Diaria, other courts understood that the crime of homicide should be criminalized, due to the principle of non-retroactivity.
The crime continues to be committed until the remains are recovered or their fate is known,” the ruling states.
Eduardo Ferro was also convicted for this case. Judge Silvia Urioste ordered in September 2023, in first instance, a sentence of 21 years in prison for the crime of forced disappearance.
Óscar Tassino was arrested on July 19, 1977 in an operation carried out by Ferro, who at that time was a captain, Ernesto Ramas and Jorge Pajarito Silveira.
He was tortured in the La Tablada detention center. His remains are still missing.
