The Fourth Chamber of the Supreme Court of Justice (CSJ), officially known as the Constitutional Chamber, confirmed the initiative as contrary to the Constitution, which coincides with criteria on the text in different forums by personalities and organizations of the Congress and of the Executive itself during the last weeks.
The announcement of the unconstitutionality of the so-called “Jaguar Law for the development of Costa Rica,” proposed by the Executive to the Legislative Assembly (parliament) for its approval by referendum, opens new fronts on the issue that this body has been dealing with for several weeks, according to local media.
The decision of the Fourth Chamber, voted by the majority of its members, responded to a consultation of the Supreme Electoral Court (TSE) on whether or not the Jaguar Law, submitted to Congress by President Rodrigo Chaves, was constitutional or not.
The magistrates of the Fourth Chamber agreed, among other responses to consultations on legality, on the unconstitutionality of clauses of the draft law conceived by the Executive to be submitted to the popular consultation of a referendum, which, in addition, weakened the control system of the Comptroller’s Office.
