The draft, named Law of Strengthening and Disruptive Actions Against Drug Trafficking Noel Kempff Mercado, is already in the hands of the Plurinational Legislative Assembly (ALP), said the minister, according to whom the bill proposes a set of measures and strengthening actions in the fight against trafficking of controlled substances, related crimes, and organized crime in defense of society.
Del Castillo described that the Anti-Narcotics Police Prosecutor’s Office will have the power to “constitute itself as a victim of society to achieve and seek a sentence” in relevant cases identified by the FELCN (Special Force Against Drug Trafficking in Spanish) to avoid judicial evasion by some traffickers due to inaction of certain judicial officers.
Unfortunately, some prosecutors abandon the case, which allows them to subsequently extinguish the process that the Bolivian Police has been carrying out thoroughly and efficiently, therefore, the bill creates the concept of the Anti-Narcotics Police Prosecutor’s Office, del Castillo said.
The draft proposes the creation of the Air Bridge Analysis Unit, which will analyze information, monitor the air traffic related to the trafficking of controlled substances, and intervene in the case of suspicious aircraft operations through a disruptive and preventive mechanism in the context of the powers of the Bolivian Police, and will process the information on the registration of aircraft, runways, airports, and pilots based on information from the General Directorate of Civil Aeronautics.
Additionally, article 10 of the proposal establishes the creation of the Counterintelligence Mechanism, which will intend “to reinforce the protection of internal security against crime and criminal organizations to prevent, detect, obstruct and neutralize operational actions (…) contrary to the purposes and institutional mission of the FELCN General Management.”
