The TSJ declared unfounded the cassation appeal filed by the defense of former president and reaffirmed the sentence for irregularly assuming the head of State in November 2019. On June 10, 2022, the First Anticorruption Sentencing Court of La Paz sentenced Áñez to 10 years of imprisonment for the crimes of resolutions contrary to the Constitution and the laws, for the illegal manner in which she first placed herself at the head of the Senate and from there at the head of the Plurinational State.
A Criminal Court of La Paz then confirmed that resolution.
On that occasion, the judge explained that the evidence presented and provided in the oral trial was sufficient for the members of the Court to have the “full conviction” on the participation and criminal responsibility of the former de facto president.
