Mexico’s Senate receives the Supreme Court Minister’s resignation

Mexico City, Nov 13 (Prensa Latina) From today, the Mexican Senate already has in its hands the resignation of Judge Arturo Zaldivar from the Supreme Court of Justice of the Nation (SCJN) of which he was president.

It is expected that during the course of this week the Upper House will accept it, a necessary step for the President of the Republic, Andres Manuel Lopez Obrador, to send to the senators a proposal that must be made up of three people.

The decision will have to be made by the senatorial plenary, as explained by the president of this chamber, Ana Lilia Rivera, who specified that, if accepted, the senators will then analyze the list of three candidates proposed by the federal Executive, in order to submit it to a vote.

She indicated that the Constitution establishes that the appointment of ministers will be made by the vote of two thirds of the members of the Senate present, within the non-extendable term of 30 days.

If the chamber does not resolve within such term, the person appointed by the President of the Republic will occupy the position of minister.

It also clarified that, in case the Senate rejects the proposed list of three candidates, the chief executive will send another one.

If this second shortlist is also rejected, the person appointed by the President within this shortlist will occupy the position.

Lopez Obrador stated that the shortlist will only be made up of women.

Although Zaldivar still has not revealed the real reasons for his resignation from his high position in the SCJN, analysts put it in the context of a muted dispute with his replacement, the conservative minister Norma Piña, who, as the government claims, has deepened the confrontation with the Executive Power.
