The political group questioned the ruling by Judge Paola Plaza, because there are pending actions to establish the crime of homicide, as well as identifying those who participated in the events.
Regarding the cause of Neruda’s death, a communiqué from the PCCh pointed out that it has been proven by panels of experts that the poet, although he suffered from cancer, did not die from that disease.
Therefore, the death certificate which establishes as cause of death a state of general exhaustion caused by cancer is false, it stated.
For these reasons, the Communist Party of Chile demanded new proceedings to establish the responsibilities of those involved in the falsification of that legal document.
Pablo Neruda’s international relevance gave him the quality to head a government in exile, something that the Augusto Pinochet dictatorship wanted to prevent since the first days after the coup d’état on September 11, 1973.
Due to the revelation of new documents in this regard, the Communist Party demanded that Peter Kornbluh, director of the Chile Documentation Project and member of the United States National Security Archive, be summoned to testify, the text added.

Another pending issue is to determine who was the person designated in charge of the clinic where Neruda died on September 23, 1973.
The communiqué also noted the need to carry out a new expert’s evaluation of the existing scientific data and to determine objectively and precisely how the writer was inoculated with the botulimic clostridium bacteria found in his body, its dosage and lethal effect.
