Guatemalan Prosecutor’s Office requested lifting TSE Immunity

Guatemala City, Sep 27 (Prensa Latina) The Public Prosecutor's Office of Administrative Crimes of Guatemala presented a request for the lifting of immunity against the magistrates of the Supreme Electoral Court (TSE), announced today the Public Prosecutor's Office (MP).

Through a press release, the judicial entity indicated that it is the president of that body, Irma Elizabeth Palencia, and the incumbents Ranulfo Rafael Rojas, Blanca Odilia Alfaro, Gabriel Vladimir Aguilera and Mynor Custodio Franco.

It included the alternate magistrates Marco Antonio Cornejo, Marlon Josué Barahona and Álvaro Ricardo Cordón, all for the possible commission of the crimes of fraud, breach of duties and abuse of authority.

The MP explained that the request is made following a complaint filed on June 29, 2023 against the aforementioned, as well as the IT Department, for possible irregularities in the subscription of the administrative contract for the purchase of the software used in recent elections.

He pointed out alleged illegalities in the awarding and subscription of the administrative contract for the tool for the Transmission of Preliminary Results, since the supplier Datasys S.A. recommended the entity Podernet, as supervisor, usurping functions of the TSE.

Likewise, he argued that the former presented his offer for an amount, while the latter suggested a lower amount of 34.892,826 Quetzales (almost 4.5 million dollars), with operating hardware and telecommunications infrastructure.

Therefore, the magistrates possibly signed the administrative contract using artifices to defraud the State, he remarked in the text.
