For this day “we are going to have an activity at the Planalto Palace (headquarters of the Executive Power) with Minister Marina (Silva) and Minister (Sonia) Guajajara and we are going to demarcate some indigenous and environmental protection issues”, Lula declared in Conversa com o Presidente, a program he broadcasts on Tuesdays through social media.
The president signed in April the approval of the demarcation of six native territories, which constituted the first approval of his third mandate and, according to the government, closed a period of five years without jurisdictions.
Carried out by decree signed by the President of the Republic, the homologation is the last act before the formal registration of the indigenous patrimony.
Lula’s announcement came at a time when the Federal Supreme Court (STF) is analyzing the so-called temporary framework that will define the future of the demarcation of the original lands. The score is four to two against the controversial thesis, which establishes that the natives only have the right to possessions traditionally occupied by them on the day of the promulgation of the Constitution, on October 5, 1988.
The initiative is an interpretation of Article 231 of the Constitution, which “recognizes the indigenous peoples, their social organization, customs, languages, beliefs and traditions”.
