Judicial sources specified that 25 women and 47 men received this status, and that since August 7, 162 releases were granted (100 men and 62 women).

Currently, 128 individuals (115 men and 13 women) are still being held for the anti-democratic actions, 49 arrested on January 8 and 9, after the events, and 79 in police operations carried out in the last months.

All these persons were denounced for crimes of armed criminal association, violent abolition of the democratic rule of law, coup d’état, damage qualified by violence and serious threat.

They also respond for use of inflammable substance against the Union’s patrimony and with considerable damage to the victim, deterioration of demolished patrimony and contests of people and material.

De Moraes considered that the factual scenario until then in force was altered due to the closing of the procedural instruction phase of the 228 prisoners, with the hearing of 719 prosecution witnesses and 386 defense witnesses, and the completion of all the interrogations.

With the above, according to the judge, precautionary detention was no longer justified, either for the guarantee of public order or for the convenience of the criminal investigation.
