Cuba strictly complied with its legal obligations in London

Havana, Apr 5 (Prensa Latina) Cuba strictly complied with its legal obligations regarding the lawsuit filed against the Republic of Cuba and Banco Nacional de Cuba (BNC) by CRF I Limited, Cuban Justice Minister Oscar Silvera affirmed on Wednesday.

The Minister told a press conference that the ruling by judge of the High Commercial Court of London, regarding the lack of jurisdiction to hear the lawsuit against the Cuban State and the certification that CRF is not its creditor, is a victory for the country.

They were seeking to condemn Cuba and they did not succeed, he stressed, adding that an unfavorable ruling would have resulted in the possible withholding of state assets and even in new impediments to access international financial flows, already reduced due to the United States economic, financial and commercial blockade and Cuba’s inclusion in Washington’s State Sponsors of Terrorism list.

These are the reasons why we say that this is a victory, he remarked.

Silvera explained that the English procedure differs in many points from the French Roman system implemented in Cuba, for which reason it has required a lot of study, learning and systematization in the analysis.

He noted that before the hearing in early February 2023, the Cuban legal team presented more than 2,000 documents and not a day has passed since the lawsuit was established in 2019 in which something has not been done for that process.

The minister thanked all the people involved in the procedure, in which English, Spanish and Cuban jurists intervened, as well as specialists from different branches.

He explained that the characteristics of the English judicial system required hiring a legal representation from that country, headed by Lawyer Alison MacDonald and her collaborators, and another team as intermediary, which was assumed by the Spanish law firm Uria Menendez.

Add to these the efforts of the temporary working group created in the Cuban Ministry of Justice with the participation of specialists from institutions such as the banking system, the Ministry of Finance and Prices, and university professors.

This, Silvera said, increased the knowledge and resolution capacity to meet all the demands from the process.

After the notification of the ruling on Tuesday, when the Republic of Cuba was exonerated from the process, the litigation against Banco Nacional de Cuba continues, hence the minister of Justice emphasized that the country will continue to defend the truth: CRF is not a legitimate creditor of any of its institutions.
