Mexico to release indigenous woman imprisoned for miscarriage

Mexico City, Dec 23 (Prensa Latina) Indigenous Nahua woman Aurelia Garcia, from the Xochicalco community in Guerrero, Mexico, was released after serving nearly unjustly three-year imprisonment for miscarrying, the National Women's Institute (INMUJERES) reported on Friday.

INMUJERES called on Mexican authorities to continue working in favor to protect and guarantee women´s, teen´s and girl´s human rights, as well as to solve this sorts of cases so that incidents like Aurelia’s never happen again.

Aurelia was hospitalized in 2019 due to a miscarriage, but was subsequently arrested for allegedly committing homicide crime for kinship reason, aberration and cruelty. INMUJERES reported that Mexico´s Supreme Court of Justice unanimously solved (by 10 votes) the Action of Unconstitutionality in September 2021.

Consequently, it ruled in favor of women and pregnant women who decide to have an abortion and the right to decide, as an exclusive right to reproductive autonomy and, therefore, to self-determination over maternity.
