The lawmaker plans to use that strategy if bipartisan talks to provide a path to citizenship for undocumented aliens residing in the northern nation collapse.

Schumer privately told members of the Congressional Hispanic Caucus that he is ‘actively exploring’ the possibility of attaching a sweeping overhaul of immigration laws to President Joe Biden’s infrastructure investment plan that includes more than $2 trillion, The New York Times reports Tuesday.

The intention is to leverage a process known as budget reconciliation with an amendment of sorts that includes the interests of Biden and his allies on the immigration issue, two people briefed on the matter told the Times.

The maneuver would allow the measures to pass through the evenly divided Senate, with a simple majority of 51 votes for those in the blue party with the support of Vice President Kamala Harris.

Organizations and activists pushing for the measures are increasingly concerned that Democrats will squander the opportunity to legalize large swaths of the undocumented population while their party controls both houses of Congress and the White House.

Biden’s plan would provide a path to citizenship for approximately 11 million undocumented immigrants and increase diversity visas and border security funding.

The White House says Biden remains committed to setting the cap at 125,000 by fiscal year 2022, which begins in October, while working to improve the country’s capabilities to accept as many refugees as possible.
