The General will be formalized on May 7TH, after the Court of Appeals of Santiago declared inadmissible a last appeal filed by his defense to avoid justice.

Yáñez served as head of Order and Security of the police during the government of Sebastián Piñera (2018-2022), and was later promoted to General.

The Prosecutor’s Office requested to prosecute the officer for the crime of omission of “illegitimate pressures resulting in serious injuries and homicide” that occurred in 2019 during the protests against social inequalities and the neoliberal model, which were violently repressed, resulting in about 30 deaths and thousands of injured, including more than 400 with eye damages.

A report by the UN Human Rights Council revealed excessive or unnecessary use of force, resulting in deprivation of life, injuries, torture and ill-treatment, sexual violence and arbitrary detentions.

The investigation pointed out that the police and the army did not adhere to international norms and standards regarding the use of force.

Media outlets claim that Yáñez will resign before sitting in the dock, especially because the Government expressed that any formalized authority must leave their position.

This week human rights organizations delivered a letter to the La Moneda Palace addressed to president Gabriel Boric, demanding the resignation of Yáñez and other senior police officials. “It is a legal and ethical duty that General Yáñez assumes his responsibilities and answers for the charges against him. He cannot continue to evade justice. Given the relevance of the position he holds, he must resign,” states the letter, which was signed by more than 70 groups.
