Details of Cuba’s Family Code explained in Spain

Madrid, Jan 8 (Prensa Latina) Details of the Cuban Family Code, approved in 2022, were explained today in Spain by Leonardo Pérez Gallardo, professor at the University of Havana.

In his lecture entitled “The Code of Families in Cuba after one year in force”, the professor of Civil and Notarial Law of the University of Havana stressed that it is one of the most advanced laws in Latin America.

The jurist, one of the drafters of the legislation, acknowledged that the text was controversial both at the academic level and among the population in general, but achieved its approval and subsequent ratification by referendum, in which 74.12 percent of voters participated and 66.85 percent endorsed it.

One of the most commented aspects, surrogacy, “defends people in vulnerable or disadvantaged situations and guarantees “that there is no exploitation of women”, according to Professor Pérez Gallardo.

It is better to control than to prohibit the so-called surrogacy (…) The way the law is drafted, it is almost impossible for a situation of exploitation of the surrogate to occur, because all kinds of guarantees are given at a legal and health level, he stressed.

On the other hand, the doctor in Juridical Sciences from the University of Havana referred to other issues such as adoption by homosexual couples, addressing gender violence and recognizing rights that favor children, the elderly and the disabled.
