Constitutional Court Guatemala denies protection to Attorney General

Guatemala City, Aug 28 (Prensa Latina) The full magistrates of the Constitutional Court (CC) of Guatemala today denied provisional protection to the Attorney General, Consuelo Porras, against the government in order to guarantee its independence.

The court reported the decision after learning about-description of file 4986-2023 that relates to the president of the country, Alejandro Giammattei, the Minister of the Interior David Barrientos, and the general director of the National Civil Police, Edwin Ardiano.

Porras demanded that the magistrates of the high court instruct those indicated to enforce the legal regime, the guarantee of their rights and the execution of judicial orders and resolutions.

In addition, he requested precautionary measures in favor of the head of the Special Prosecutor’s Office Against Impunity, Rafael Curruchiche, and the fiscal agent Cinthia Monterroso.

He claimed for the use of uniformed officers if necessary and, when there are clear indications of an imminent threat of serious violence, he added.

He included in the petition that preventive measures be adopted in favor of the search to guarantee compliance with the constitutional function that corresponds to the MP.

All of this, explained analysts, as a result of demonstrations due to the continuous interference in the electoral process and the call for the resignation of Porras and the other two prosecutors.

“The three bishops of the corrupt pact in the MP, abusing power, restricting political freedom,” protesters wrote last Friday on a banner they placed on the bars of headquarters of the investigative body.

In that same place they inserted the photographs of Porras, Curruchiche and Monterroso, apart from the strong comments against them on social networks.

“There are 2.4 million free and democratic votes. Lay off now”, stressed the participants in the protest in reference to the ballots supporting the winning candidate of the Movimiento Semilla party, Bernardo Arévalo.

Just two days before the elections on Sunday, August 20, Curruchiche asked the Supreme Electoral Tribunal (TSE) for data on the first and second round of the votes cast.

In another action on the same day, the Prosecutor’s Office against Electoral Crimes asked to withdraw the immunity of the director of the Citizens’ Registry of the governing body of the voting process, Ramiro Muñoz, for the possible commission of crimes.

The entity also demanded the lifting of the immunity of the presiding magistrate of the Guatemalan TSE, Irma Palencia, for alleged crimes.

Local and international organizations, including the Secretary General of the United Nations, Antonio Guterres, expressed concern about attempts to undermine the results expressed at the ballot box.
