Court in Peru rejects complaint of candidate’s death threats

Lima, Jul 18 (Prensa Latina) Yesterday, Peru's Constitutional Court declared inadmissible a complaint against the current mayor of Lima, Rafael López Aliaga, for threatening to kill the then presidential candidate Pedro Castillo during the campaign in 2021.

The decision encouraged opposition claims that the conservative majority Congress is taking over the powers and institutions of the State by appointing authorities with similar interests.

The mentioned court dismissed the complaint filed because in May 2021, the current mayor, Rafael López Aliaga, launched threats in an electoral rally against Castillo, the winner in the electoral race.

López Aliaga shouted “Death to communism, death to Castillo, death to Cerrón!,” the latter the physician Vladimir Cerrón, leader of Perú Libre, the party of which Castillo was a candidate, later elected head of state and dismissed and imprisoned.

Despite the explicitness of the exclamations, the Constitutional Court considered that “it does not constitute the irrefutable proof of a certain and imminent threat to the rights to life and personal integrity”.

The complaint was previously dismissed by the Judiciary and requested that the court require the current mayor of Lima to “refrain from attempting against the life and personal integrity” of Castillo and Cerrón, since they have been publicly threatened with death”.

After the 2021 incident, the Electoral Honor Court criticized the threat of the right-wing politician, who alleged that he had referred to a “political death”.

The Ethics Tribunal ruled that “The instigation of death, without simultaneously clarifying whether it is a real or political death, during public speeches not only undermine the foundations of democracy but also generate an atmosphere of intolerance and incitement to hatred and eventual violent actions in the population”.
