The TSJ pointed out that elements of conviction are evident that compromise his responsibility, for the alleged commission of crimes typified in Venezuelan anti-corruption legislation.
He pointed out that, because it deals with the flagrant commission of common crimes, the preliminary trial of Roa is not appropriate, for which reason his prosecution corresponds to the competent ordinary courts, according to the provisions of article 378 of the Organic Code of Criminal Procedure.
The sentence ordered the notification be made to the National Assembly (Parliament), declaring the detention of the mentioned citizen admissible, and ordering him to remain in custody by the State security forces.
He added this will be done until the Legislative Branch decides on the waiver of parliamentary immunity, as provided for in article 200 of the Constitution.
Likewise, it ordered these proceedings be forwarded to the Attorney General of the Republic, Tarek William Saab, so that the corresponding investigation and prosecution may continue, in accordance with due process and other corresponding constitutional guarantees.
Parliament backed last Tuesday, categorically and with a qualified majority, an agreement in support of the actions promoted by President Nicolás Maduro and State institutions against corruption.
Presented by the head of the official Bloque de la Patria, Diosdado Cabello, the document ratified the unwavering commitment to fight against this scourge as a necessary contribution to give solidity to the institutional framework, in addition to promoting and guaranteeing peace as the supreme objective of the Venezuelan people.
He also made available to democratic institutions his inalienable conviction to combat the scourge of corruption and expressed the firm certainty that these actions by the Bolivarian Government and the State will serve as invaluable support to solidify the ethical principles and values of the political system.
Before the end of the ordinary session, the legislative body unanimously approved the petition to waive the parliamentary immunity of Deputy Roa, in order to continue with the trial for committing acts of corruption.
