The Caribbean nation maintains in force a decree law that regulates the aspects related to these areas and dates from 1978, but the new Constitution and the changes in the socioeconomic reality of the country determined its updating and elevation in legal rank.
This was explained by Diana Rosa Suárez, legal director of the National Institute of Territorial Planning and Urbanism, when presenting the regulations to parliamentarians, which has gone through several moments of debate both by legislators and by organizations, institutions and universities linked to these issues.
Suárez specified that 271 criteria were collected, 236 of them proposals, and in the project that the National Assembly of People’s Power (parliament) will take into consideration for approval, next Tuesday, 58 percent of those ideas were included.
The population also contributed opinions for the improvement of the legal body, through the website of the Assembly, the enabled e-mail and other channels.
The proposed law updates the legal framework in such a way as to articulate and coordinate the different competences that affect the territory, and adequately regulate the requirements of planning, management, control and territorial and urban discipline.
In this sense, it establishes the instruments for this, its content, scope, approval and management levels; as well as the instruments for soil management, which allow its rational and sustainable use.
In addition, it defines the responsibilities of the local organs of People’s Power, the actors involved in these processes, the urban land regime, among other matters.
According to Suárez’s explanation, it is aimed at ensuring the effectiveness of constitutional rights, in particular those relating to the enjoyment of personal property assets related to the ground, to a healthy and balanced environment, to a safe and healthy habitat. , and to adequate housing.
The regulations also promote the protection and rational use of the country’s natural resources, the preservation of the cultural and natural heritage, all in close connection with the sustainable development of the economy and society, through public policies and provisions.
