Five out of seven TSE judges voted against the lawsuit filed by the ‘Happy People Again’ coalition, made up of the Workers’ (PT), Brazilian Communist and the Social Order Republican parties.

The group of five judges dismissed the claims for abuse of economic power and improper use of media by the Bolsonaro-Mourão pair.

According to the defense of the governor and his vice, there is no solid evidence of the accusations, only newspaper articles without foundation.

The case resumed this Thursday with the vote of Minister Carlos Horbach, who followed the same understanding, completing a majority among the seven members of the court.

For Horbach, the existence of a scheme aimed at issuing messages with false information against Bolsonaro’s opponents in 2018 was not even proved, as indicated in the initial petition that led to the process.

The minister assured that, throughout the instruction, neither party was able to prove ‘the content of the messages, the way they had an influence within the electorate, and its scope’, so he voted to completely reject both so-called Electoral Judicial Investigation Actions in the trial.
